Abstract

This study aims to analyze and construct the limits of state obligations in earthquake disaster risk reduction in Sulawesi based on the Sendai Framework 2015-2030, emphasizing the integration of seismic threats into spatial planning. This normative legal research employs statutory and conceptual approaches. The findings reveal that state obligations rest on three pillars: the right to safety as a constitutional mandate, the paradigm shift in disaster law from reactive to proactive, and the position of spatial data as the legitimacy basis for spatial planning. Although the Sendai Framework is soft law, it holds normative significance and has influenced regional policies in Sulawesi. However, implementation remains weak due to the gap between normative recognition in Regional Regulations and policy execution and inadequate budgeting. The local government's continued focus on emergency response indicates that the disaster management paradigm has not shifted to disaster risk management. This study recommends regional governments revise spatial regulations based on scientific data, shift paradigms toward disaster risk management by strengthening BPBD capacity, public participation, and SNI implementation, while the central government revises Presidential Regulation 8/2008 to strengthen vertical coordination between BNPB and BPBD.
