Penelitian ini didasari atas dinamika perkembangan teknologi Artificial Intelligence di
Indonesia yang tidak diikuti dengan perkembangan regulasi yang mumpuni yang pada akhirnya
melahirkan problematika multidimensional khususnya dalam kaitannya dengan Kekayaan
Intelektual. Berbanding terbalik dengan Uni Eropa yang telah diklaim mampu memberikan
perlindungan terhadap permasalahan tersebut melalui pengaturan komprehensifnya terkait
dengan Artificial Intelligence, European Union Artificial Intelligence Act. Melalui penelitian
ini, peneliti berhasil untuk mengumpulkan, menganalisis, dan menjelaskan problematika dalam
perkembangan Artificial Intelligence yang terjadi dalam dimensi Kekayaan Intelektual, seperti
penggunaan tanpa hak suatu kekayaan intelektual dalam proses pembelajaran Artificial
Intelligence, kaitannya dengan Kekayaan Intelektual sebagai data pribadi, dan kurangnya
perlindungan dalam regulasi yang ada. Disimpulkan juga bahwa perlindungan hukum yang
diberikan oleh European Union Artificial Intelligence Act terhadap Kekayaan Intelektual
semestinya dapat dijadikan acuan dalam penyusunan peraturan komprehensif sebagai solusi
penyelesaian problematika yang muncul di Indonesia.
