HAK DAN KEDUDUKAN ANAK SEBAGAI SUBJEK HUKUM PADA PASUBAYA MAWARANG DALAM PERKAWINAN PADA GELAHANG

This study aims to analyze the rights and legal status of children as legal subjects within Pasubaya Mawarang in
pada gelahang marriages, as well as to examine its normative relevance to the principles of justice and child
protection within the framework of Balinese customary law. The research employs a normative legal method with
a statutory approach, analyzing provisions from the Civil Code, the Marriage Law, and the Child Protection Law.
The findings indicate that Pasubaya Mawarang possesses legal legitimacy as long as it fulfills the validity
requirements of agreements stipulated in Article 1320 of the Civil Code and does not contradict the best interests
of the child. Children born from pada gelahang marriages must be recognized as independent legal subjects with
equal civil rights and legal protection, ensuring that Balinese customary values coexist harmoniously with the
principles of justice and child protection within the dynamic framework of the national legal system.
