Abstrak

Penelitian ini mengkaji rekonstruksi perlindungan hukum atas alat bukti hak ulayat pasca berlakunya Peraturan Pemerintah Nomor 18 Tahun 2021 dalam perspektif keadilan prosedural. Fokus utama penelitian diarahkan pada persoalan delegitimasi bukti adat dan belum optimalnya pengakuan terhadap bukti sosial komunal dalam sistem administrasi pertanahan Indonesia. Penelitian ini menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan kasus. Bahan hukum dianalisis secara preskriptif untuk menilai konsistensi norma, menemukan kelemahan pengaturan, dan merumuskan model perlindungan hukum yang lebih adil terhadap pembuktian hak ulayat. Hasil penelitian menunjukkan bahwa pengaturan dalam Peraturan Pemerintah Nomor 18 Tahun 2021 telah membuka jalur formal tanah ulayat melalui skema hak pengelolaan, penetapan oleh Menteri, pendaftaran, dan sertifikasi. Namun, model tersebut masih menempatkan validitas hak ulayat dalam rezim pengakuan negara dan belum secara tegas merekognisi riwayat penguasaan kolektif, pengakuan masyarakat adat, batas alam, dan legitimasi lembaga adat sebagai bagian mandiri dari sistem pembuktian pertanahan nasional. Dalam perspektif hukum acara, bukti adat sesungguhnya dapat dihubungkan dengan alat bukti tertulis, saksi, dan persangkaan. Penelitian ini menyimpulkan bahwa kepastian hukum tanah ulayat harus dibangun melalui rekonstruksi normatif yang mengintegrasikan hukum adat, hukum pertanahan, dan keadilan prosedural agar perlindungan hak masyarakat hukum adat menjadi lebih substantif dan operasional.
